Booking information & Terms of Booking

Definitions

'You' means the person or persons booking the cottage

'Us' or 'We' means Simplytime in Cornwall

'cottage or property' means the premises which has been booked for  the rental period

Deposit

A deposit of 20% of the rental fee is immediately payable by You  unless the booking is a Late Booking (see below). Until this deposit is  received We reserve the right to cancel the reservation, A receipt will  be sent to you along with confirmation of the latest payment date for  the remaining balance.

Final Payment

The balance of the rental fee is payable not less than eight weeks  before the rental period; the latest date for this payment can be found  on your deposit receipt. Should payment not be received your booking may  be cancelled by Us and the deposit forfeit.

Security Deposit

A refundable security deposit of £500 is payable by You and is due  not less than eight weeks before the rental period. The security deposit  will be returned promptly to You unless deductions are necessary as a  consequence of any breach of this agreement (including but not limited  to: additional cleaning, breakages, damage, loss of cottage property and  postage of any items left at the cottage). Should any deductions be  necessary by Us a full breakdown will be sent to You.

Late Booking

If you are booking your holiday less than eight weeks in advance of  the rental period, payment of the full rental fee and security deposit  are due immediately.

Cancellation

Cancellation of your booking not less than eight weeks prior to the  rental period will result in the forfeit of the deposit. The security  deposit will be returned to you in full.

Cancellation less than eight weeks prior to rental period will result  in the forfeit of the total rental fee. The security deposit will be  returned to you in full.

If the cottage can be re-let by Us at this short notice, which may be  at a reduced rental we may (at our discretion) reimburse to you the sum  received for the subsequent rental less an administration fee of 20% of  your rental fee.

Arrival & Departure Times

You will have access to your cottage from 4.30 p.m. on your arrival  day. The keys to the cottage will be left in a location, detailed in  your cottage pack, which will be sent to you when the final payment has  been received. On your departure day, the cottage must be vacated by  10.00 a.m. Failure to vacate by 10.00 am will result in an excess charge  of £50 per hour for any excess period of occupation.

Care of the Property

You must take all reasonable and proper care of the cottage, inside  the property and in the garden, and any furniture, pictures, fittings  and effects in or around the property and leave them in the same state  of repair and condition at the end of the rental period as found at the  beginning.

You must keep and leave the cottage in a clean and tidy condition,  including all cutlery and crockery cleaned and all rubbish removed and  placed in appropriate bins/recycling bins. If we are alerted to concerns  surrounding the care of the cottage, or disturbances, we reserve the  right for us or our agents, to enter the property to carry out  appropriate checks and we reserve the right to ask you to vacate the  property with immediate effect if it is found in a neglected or damaged  condition. Failure to meet this standard may result in deductions being  made from the security deposit. If we are dissatisfied with the  condition of the Cottage upon your departure, we may refuse to take a  booking from you again.

You agree to respect the surroundings and not disturb any  neighbouring properties, as well as adhering to any specific property  restrictions in terms of noise restrictions that are in place at the  cottage (if any).

Party Size

The number of persons in the party must not exceed the number  confirmed on the booking form. Additional guests (up to the maximum  permitted) added to the party after the original time of booking will be  subject to a charge of £30 per person payable before the holiday.

Smoking

Smoking is not permitted inside the Cottage. Failure to adhere to  this will result in a loss of your security deposit.

Exclusion of Liability

We (including our employees and agents) shall not (insofar as is  permitted by law) be under any liability to you and your party or third  parties for any accident, damage, loss, injury, expense or  inconvenience, which may be suffered, incurred or arise out of or in any  way be connected with the rental of the cottage.

No term of the Contract is enforceable under the Contracts (Rights of  Third Parties) Act 1999 by a person who is not party to the Contract.

Exclusion of Liability for Suppliers Goods and Services

We include a number of suppliers on simply time in cornwall.co.uk and  can accept no liability for any goods or services provided by these  suppliers. You should check that you agree to the suppliers' own terms  and conditions before trading with them.

Property/Maintenance Issues

In the unlikely event that any issues arise during your stay,  including maintenance, please contact us immediately. It is a condition  that you communicate any problem with the cottage during your holiday,  if you fail to do this then we cannot accept any responsibility as we  have been deprived of the opportunity to investigate and resolve the  problem. If you feel that your complaint still stands on the completion  of your holiday we would request that you follow this verbal complaint  by writing to us within seven days of your departure from the property.

Insurance requirements

Holiday and Travel Insurance, including cancellation cover, is  essential for your own protection and we advise you, to be suitably  insured. We strongly recommend that Travel Insurance is taken out prior  to your holiday. (Please make certain that your insurance cover includes  loss of initial payments and cancellation)

Force Majeure

Compensation payments do not apply where performance of the contract  is prevented by risk of war or threat of war, riot, civil strife,  industrial dispute, terrorist activity, natural or nuclear disaster,  fire, adverse weather conditions, technical problems of transport,  closure or congestion of airports or ports, cancellations or changes of  schedule by scheduled airlines and any events beyond Our control.

If Simply Time in Cornwall cancels your Holiday

Although it is unlikely, we reserve the right to cancel your holiday,  if for reasons beyond our control the property is no longer available.  In this event we will inform you, as soon as possible and you will be  offered the choice of an alternative holiday of at least comparable  standard, if available, or a refund of all monies paid, provided it does  not arise from reasons of Force Majeure, as set out above. By accepting  the alternative property you agree to our Terms and Conditions. If the  alternative is less expensive than the original property booked you will  receive a refund for the difference, if it is more expensive, you will  be asked to pay the difference.

Pets

Pets are only allowed in certain properties and only with Our written  consent prior to booking. Pets are only accepted subject to you  accepting liability for any damage they may do and on the condition they  are not left unattended in the property. There is an additional charge  of £50 and the following conditions apply:

  • a. Dogs must be under strict control at all times while in the  property and must be kept down stairs at all times.
  • b. Any fouling of lawns etc. must be cleared up without delay.
  • c. You must bring the dog's bed or basket for sleeping in.
  • d. Dogs MUST NOT lie on furnishings, and hair must be well cleared  up before departing.
  • e. Pets bedding and other effects must not be washed in the washing  machine.

Failure to comply may result in termination of rental without  compensation and additional charges.

Breach of Contract

If any of the above conditions are breached by you or any member of  your party, we reserve the right to re-enter the property and request  that the party leave the property with immediate effect.

This Agreement, and any issues or disputes of whatever nature arising  out of or in shall be governed by and construed in accordance with the  Laws of England and Wales.

The Parties submit to the exclusive jurisdiction of the courts of  England and Wales.
